Agistment Rules

 

THE FOLLOWING ARE OUR RULES OF AGISTMENT

 

AGISTMENT FEES:

Your agistment fees are those that are agreed upon with yourself, the horse owner (agistee) and us, Arkaba Farm, the landholder (agistor).
The agistment fees cover the cost of the paddock, and use of our facilities.
 
There can be a price increase of fees at any time by Arkaba Farm, but a four week notifying period will take place.
Your fees start from the day your horse arrives at Arkaba Farm.
We are not able to hold paddocks for agistors should you leave the property for an extended period of time.
All fees must be paid a minimum one week in advance at all times. You can pay weekly, fortnightly, or 4 weeks, but it must be in advance.
A $5.00 per week or part there of, book keeping fee is charged on any overdue agistment. Once your agistment becomes two weeks overdue, a $10.00 per week or part there of, book keeping fee is charged on any overdue agistment. If you are late paying, please automatically add the extra fees to your agistment for every week or part there of, that you are late.
Please pay your agistment fees by placing it in an envelope and putting it in the arena money box with your name on the envelope. A receipt will be given to you at the first possible convenience.
If paying by cheque, please make cheques payable to Emily Bennett. You can also pay by direct bank deposit. Please ask us for our bank details.
All horses are to be vacated from their paddock, and the paddock and feed shed cleaned by 4pm on the day they are leaving. Otherwise a $10 per day or part there of agistment fee will be charged.
Once you move your horse from Arkaba Farm, or change paddocks at Arkaba Farm, you must clean your paddock of manure, and clean out your feed and tack area by 4pm on that same day, or a cleaning fee of $50 will be charged to you.
Horses must not be removed from Arkaba Farm’s property until all fees owing are paid in full, the paddock and feed shed cleaned, or the cleaning fees paid in full.
If you are asked to leave Arkaba Farm with your horse for any reason, you will have 7 days from when notice is given, to vacate the property. During that time, you or anyone else is not permitted to ride your horse on Arkaba Farm property, or use any of Arkaba Farm’s facilities.
After an agistment agreement has been terminated by either the agistee or agistor, any items left at Arkaba Farm after the agreed termination date, will become the property of Arkaba Farm.

Under the Impounding of Livestock Act 1994 (Updated January 2006), it provides landholders with a legal process and means of recovering horse agistment expenses where payments are in default.
If your horse agistment at Arkaba Farm becomes overdue for more than 14 days, (unless prior arrangements have been made with us) your paddock will be padlocked, or your horse will be moved to another paddock on Arkaba Farm property at our discretion and padlocked. You will be sent an overdue account at this time informing you of the costs owed, including extra costs incurred by us for caring for the horse and book keeping fees between the date the default occurred and extinguishment of the contract, and costs incurred relating to the intended sale of the horse. Any tack that you have on the property will also be locked up for future sale if your fees are not paid. You will also be informed that if the money owing has not been paid within 28 days from the date the overdue account was served, we can sell your horse to recover debts. It is an offence under the Act for a person to remove a horse during this time, without the permission of the landholder. If during this time you want to collect your horse, all fees must be paid for in full, at your normal agistment rate, plus late fees, as well as any other debts incurred by Arkaba Farm i.e. feeding, farrier, vet, worming, harrowing of paddock etc. before your horse is allowed to leave Arkaba Farm.
 

RISK OF LOSS:

While your horse is agisted at Arkaba Farm, Arkaba Farm shall NOT be liable for any sickness, disease, injury or death suffered by the horse or any other cause of action arising from or connecting to the agisting of your horse. All reasonable and proper care of the property is taken by Arkaba Farm, but all risks are assumed by the owner of the horse. The owner agrees to hold Arkaba Farm harmless from any loss or injury to the agisted horse. All costs, connected with agisting are borne by the horse owner.
It is the horse owners responsibility to insure their horse and horse gear/equipment against all risks while they are on the property or being transported.
Arkaba Farm will not remove agisted horses from the property without the horse owners consent, except where the horse is being sold to cover costs by Arkaba Farm, or there is an emergency (for example, fire or flood). In this case Arkaba Farm will promptly inform the horse owner of the new location of the horse.
 

VET, FARRIER AND CHIROPRACTOR:

Arkaba Farm will notify the horse owner immediately if they become aware that the horse is suffering from any significant or noticeable sickness, disease or injury. We request a list of your vet and farriers name and phone numbers along with any phone numbers that you can be contacted on in an emergency upon arrival to the property. If your horse is badly injured or very ill and we are unable to contact you immediately, we will call your vet on your behalf. All costs must be paid for by you, the agistee. Please advise us if you change vet or farrier. If you have not specified a vet, or we cannot get in contact with your specified vet, then we will call the nearest vet in the area in the case of an emergency, and you will be liable for all vet costs. We are not responsible for holding your horse for your vet unless it is arranged prior or in an emergency situation.
It is not our responsibility to hold your horse for any equine carer unless prior arrangements have been made. We are not able to move horses into small holding yards for your equine carer to work on.
We are not responsible for holding your horse for you farrier unless you use the resident farrier. In this case we will organise your horses farriering needs as we do our own horses. If you have any special requests please tell us so that we can ensure these needs are met. Your farrier must clean up after himself i.e. pick up all nails and put them in the bins provided, and take with him old horse shoes. This is your responsibility to make sure that they do this, otherwise that farrier will be asked not to return to Arkaba Farm.
 

FEEDING/ WATERING/ RUGGING:

It is your responsibility to provide hard feed for your horse. This must be in the feed shed with clear feeding guidelines given to us. All feed must be of good quality otherwise it will not be fed and the owner notified.
Arkaba Farm will maintain all water troughs and fences, but please advise us if you notice a problem with them.
Arkaba Farm will not allow the watering of grass for either irrigation or the softening of ground.
All rugs must be of good order and safe in every feasible way.
 

WORMING, DRENCHING, VACCINATING, TEETH etc:

We are very particular about worming at Arkaba Farm. Therefore your horse must be wormed every 6 weeks.
It is your responsibility to maintain the condition of your horses teeth although we organise to have a dentist out approximately twice a year.
You are required to vaccinate your horse against tetanus and strangles regularly.
 

HELMETS AND SAFETY BOOTS:

All persons riding a horse on Arkaba Farm property MUST wear an Australian Standards Approved riding helmet. You MUST also wear protective shoes while on the property. This means all agistees, friends, children, instructors, prospective horse buyers etc. All agistees are held responsible to inform any persons entering the property on their behalf, that they must adhere to these rules. Due to insurance regulations, any person not adhering to these rules will be asked to leave Arkaba Farm permanently.
 

WASH BAY/ UNDERCOVER AREAS:

These areas are provided for your use. YOU are expected to keep them clean. Arkaba Farm will not clean up after you. Pick up any rubbish, horse hair etc. and put in the rubbish bins provided. Pick up your horses manure and put in the manure pit.
Lights are provided in all areas of the facility shed for your use. However please only turn on the lights that you need to use and turn them off when you have finished. This includes the arena lights.When you have finished riding in the arena please turn them off while you untack. Only turn them on as you are just about ready to ride. (i.e. just before putting you bridle on!) These lights require ALOT of power and therefore cost alot to run. Please be mindful of this.
If any of the taps are left on there is an immediate fine of $50. This will be charged to your account.
 

TACK AND FEED ROOMS:

You can use the rooms provided for storage of your feed and tack etc. This is done at your OWN risk. Please keep these rooms clean, as you are the ones using it, not us. You are sharing these rooms with other agistees so please do not touch their belongings. Please do not smoke in these rooms. A key will be issued if wanting to use the tack shed. If this key is lost a $20 fee will be charged to you. The key must be returned the day your horse leaves the property.
 

HOURS OF AGISTMENT:

There are no restrictions on what hours you may come and go from the property. We do however, expect orderly behaviour and respect for other agistees, us as residential owners, and other residents nearby.
 

MUCKING OUT PADDOCKS:

It is your responsibility to pick up your own horses manure. Please do this as often as possible to keep your paddock clean and free of disease and worms. Place manure in the manure heap.
If you do not muck out your paddock, there will be a $50 fee, charged to you once a fortnight, for Arkaba Farm to clean your paddock.
 

SPRAYING OF PADDOCKS:

All paddocks are sprayed regularly by Arkaba Farm for weeds. It is a condition of agistment that we are allowed access to your paddock at all times to do this at our convenience, or to do any other work on the paddock that needs doing.
 

CONSTRAINMENT OF HORSES:

All horses must be constrained at all times on the property, except for in your paddock. This is for the safety of all horses, people, cars and floats. You are responsible to pay for any damage caused by your horse to any person or their property. You may graze your horse in the laneways as long as they are on a lead. All manure must be cleaned up from the laneway and car park area.
 

ROUND HAY BALES:

Round bales are not permitted in the paddocks.
 

ENTERING AND LEAVING THE PROPERTY:

You can enter and leave the property from the main entrance off of Native Avenue or the fire track entrance. If entering by the fire track the bottom gate must be shut at all times. If entering via the house (i.e. the main entrance) no car is to go faster than 40km/hour. Cars are to be driven at WALKING PACE only around the arena. Anyone caught speeding on the property will be asked to leave Arkaba Farm permanently. Please tell your friend's, farrier's, horse feed deliveries, vet's etc, as they are your responsibility, and will not be welcome back.
 

HORSE FLOATS:

Horse floats can be left at Arkaba Farm at fee of $10 per month. Your horse float is stored here at your own risk. Once you leave Arkaba Farm, your horse float must be taken with you, it cannot be left here. Please keep the area around your float clean and tidy. When you take your float out for the day, do not leave bricks/wood etc, in the grass, put them in your float. If we mow while you are gone, the bricks/wood will damage our tractor tyres and slasher if they cannot be seen in the grass.
 

OTHER HORSES:

NO other horses other than those agisted on the property or hiring the arena are permitted to use any of Arkaba Farm’s facilities at any time due to insurance reasons.
 

DOGS:

NO dogs are permitted on the property at any time, unless by prior arrangement. Then they must be on a lead at ALL times. Please make sure that your friends, farriers, vets etc, do not bring dogs, or else they keep them in their cars.
